Property Damage – Insurance Bad Faith

Company, One Beacon Insurance, and Vericlaim, Inc. for breach of contract, breach of the duty of good faith and fair dealing, violation of the Texas Insurance Code – Unfair Claim Settlement Practices Act, violation of the Prompt Payment Act, violation of the Deceptive Trade Practices Act (DTPA), and Fraud, arising from the wrongful denial of a property insurance claim for damages that occurred in the hail storm that hit the Dallas, Fort Worth, and North Texas area in April 2014.

Atlantic Specialty Insurance Company and One Beacon Insurance, along with their adjusters at Vericlaim, Inc., were responsible for handling the payment of benefits to allow the repair of multiple commercial properties, including airplane hangars. Unfortunately, instead of paying the full value to allow timely repairs, Atlantic Specialty Insurance Company, One Beacon Insurance, and Vericlaim, Inc. took every step to undervalue the property damages and delayed payment every step of the way. As a result, Doyle LLP’s Client was left to make temporary repairs as best as possible and suffered from an interruption in its normal business operations.

The suit seeks payment of the insurance benefits under the policy, interest for the delayed payment of benefits, attorneys’ fees, and other damages associated with the delay in repairs to the roof, ceiling, interior, and other structures of the commercial buildings involved.
