Inadequate Security/ crime victim lawsuit (Ardon)
Doyle Dennis Avery LLP Trial Lawyers has been retained by the family of a victim of a deadly criminal assault in an inadequate security case alleging negligence, wrongful death, and violations of the Texas Deceptive Trade Practices Act, against APTMC, LLC d/b/a Magnolia Cove Apartments and Gatesco, Inc. The suit alleges that APTMC, LLC d/b/a Magnolia Cove Apartments and Gatesco, Inc. negligently operated the Magnolia Cove Apartments, located in North Houston, and failed to provide security which resulted in multiple violent crimes that were not disclosed to potential or current tenants. The case will be tried to a Jury of Harris County citizens in the 129th District Court of Harris County, Texas.
On November 8, 2016 at the time and on the occasion in question, Doyle Dennis Avery LLP ’s clients were residents of the Magnolia Cove Apartments located at 197 Goodson Drive, Houston, Texas 77060. Doyle Dennis Avery LLP ’s client was briefly parked his truck near his apartment unit to load a ladder onto his truck. After he exited his vehicle and was on his way to his apartment unit, a red Nissan Altima drove through the ungated entry, which was missing the entry gate, into the apartment complex. A criminal exited the Nissan and shot and killed him in a robbery attempt.
The suit alleges that APTMC, LLC d/b/a Magnolia Cove Apartments and Gatesco, Inc. knew or should have known that the premises required security measures. Defendants knew or should have known of numerous incidents before the incident forming the basis of the Plaintiffs’ lawsuit, but refused to take reasonable steps provide for the safety and security of those who were either tenants or guests of the tenants of the Magnolia Cove Apartments. Defendants failed to provide adequate security and safety measures, as well as measures, to the tenants and guests of the Magnolia Cove Apartments.
The suit further alleges that the condition at the Magnolia Cove Apartments was such that it created an unreasonably dangerous condition which Defendants and/or Defendants’ agent knew, or should have known, was unreasonably dangerous and Defendants and/or Defendants’ agent failed to exercise ordinary care to provide reasonable safety and/or to adequately warn Doyle Dennis Avery LLP ’s client, of the dangerous condition. APTMC, LLC d/b/a Magnolia Cove Apartments and Gatesco, Inc.’s failure to correct the condition and/or to adequately warn Doyle Dennis Avery LLP Client and his family, particularly when they renewed their lease, constituted negligence, and such negligence was the proximate cause of the Doyle Dennis Avery LLP ’s Client’s resulting injuries and death.
The suit seeks compensation for the surviving family members, including his wife and young daughter, including lost earning capacity, loss of consortium, mental anguish, and pain and suffering, among other damages.
