Doyle Dennis Avery LLP Trial Lawyers has filed suit against Smith International, Inc. d/b/a Schlumberger (“Schlumberger”) for discriminatory conduct and retaliatory firing of Plaintiff. The improper actions on the part of the defendant stem from our client reporting an on the job injury claim. The actions alleged against the defendant are in direct violation of the Texas Labor Code.
On or about June 7, 2014, our client experienced an injury to the left hand while performing work on a field site operated by the defendant. Our client was jacking up pipe when Plaintiff’s hand was suddenly caught between jack and pipe, compressing the hand between the two. Plaintiff immediately sought out assistance from the direct supervisor and coworkers that witnessed the incident. Instead of assisting Plaintiff with professional medical care, our client was instructed to wrap the hand and put it on ice to help with pain and swelling.
Following this incident our client was subject to improper guidance and intentionally discriminatory actions that culminated in termination. Failures attributable to the defendant include insufficient training, improper reporting of the injury by supervisors, and improper assistance in treating the injury. Agents of the defendant continuously misguided Plaintiff, leading our client to believe the injury was properly documented. Following the injury, Plaintiff was scheduled in concurrent shifts which prevented our client from seeking out proper medical care.
Upon finally seeking out professional treatment on a day off, Plaintiff required surgery and casting to repair the significant damage to the hand. Instead of supporting their injured employee, defendant responded by terminating employment for Plaintiff during the period of professionally recommended recovery. Termination and improper reporting left Plaintiff with the burden of handling further medical expenses and seeking out future means of support in a period our client was meant to dedicate to recuperation.
