Doyle Dennis Avery LLP Trial Lawyers has filed suit against Liberty Mutual Fire Insurance Company (“Liberty Mutual”) and associated claims adjuster Clayton Milton. The suit is needed to address allegations that the Defendants’ improperly handled an on the job injury claim made by the Plaintiff.
Our Client, a loyal and hardworking employee of EPCOR Water USA, was injured in the course of employment on January 30, 2012. Upon receiving the claim for an on the job injury Liberty Mutual placed Mr. Milton as the adjuster in charge of processing Plaintiff’s claim. Mr. Milton caused to be filed a notice of Claim Status form with the Industrial Commission of Arizona (“ICA”), Claims Division, which created the direct result of ceasing and denying further medical and income benefits to our client.
This denial of compensation was eventually overturned upon appeal to the ICA, an act that restored owed benefits to continue for our client. Liberty Mutual failed to even show up at the hearing to justify why they ceased paying Plaintiff’s claim in the first place. Even though the ICA ordered payments to be restored, Liberty Mutual continued to deny authorization for surgery, and without competent medical evidence, required our client to pursue conservative treatment in direct conflict with the advice of Plaintiff’s doctors.
Liberty Mutual finally authorized surgery a year after the Plaintiffs doctor recommended it. The authorization followed our client’s actions of hiring legal counsel in support of due payments. Rather than properly investigate and pay benefits as ordered, Liberty Mutual and Crayton Milton delayed and improperly handled our client’s claim for an on the job injury. Throughout this whole process Liberty Mutual’s actions caused undue physical and mental suffering for our client. Even with surgery the Plaintiff’s experience will continue to have lasting effects.
