Today, the federal court dismissed the claims of the Indiana National Guardsmen in ‘McManaway et al v. KBR, Inc.’ pending in Evansville, Indiana. The Court found that the KBR defendants could not be sued in Indiana.
On March 31, 2010, Doyle Dennis Avery LLP re-filed the legal claims of the Indiana Guardsmen exposed to the highly toxic chemical sodium dichromate at KBR’s Qarmat Ali project in southern Iraq (including the widow of Lt. Col. Jim Gentry, who died from his exposure in November 2009) .
Today Judge Paul Papak issued a memorandum opinion and order denying KBR’s motion to dismiss claims of former members of the Oregon National Guard for lack of jurisdiction.
