Doyle LLP Trial Lawyers has filed suit against Kirby Offshore Marine Operating, LLC (“Kirby”) alleging negligence, unseaworthiness, and wrongful termination. The case is a result of an the job injury sustained by Plaintiff that occurred on August 20th, 2014.

Our client was employed as a first mate on a Kirby run barge vessel operating in Alaska (the Arctic Circle). In the course of his duty, Plaintiff was required to place a large Yokohama Type Barge Fender over the side of the vessel using a crane.

While performing this task Plaintiff experienced strain in the left arm, back, and neck area. Our client immediately reported his injury to supervisors, beginning a process of visiting expensive specialist with the hope of resolving pain and returning to work.

The lack of proper equipment and manpower supporting our client directly contributed to the avoidable injury. In addition to the lack of necessary equipment, Kirby had insufficiently and even improperly trained their employees regarding this dangerous task. Instead of taking responsibility for their dangerous omissions, Kirby took the path of denying any significant responsibility.

Plaintiff was eventually terminated from employment, leaving our client the burden of figuring out how best to treat his lingering injuries with the absence of stable income and company provided insurance. No person deserves to be put in such a difficult situation through no fault of one’s own.
