Judge Rejects Adjuster’s Attempt to Escape Liability in Arizona Worker’s Comp Bad Faith Claim

A federal judge in Arizona has denied Sedgwick Claims Management Services, Inc.’s (“Sedgwick”s), motion to dismiss a lawsuit filed against the adjusting company for aiding and abetting the actions of Ace American Insurance (“Ace”). Sedgwick was the adjuster and third party administrator assigned by Ace to handle and process the plaintiff’s claim.

Judge Denies SeaBright Insurance Push to Shirk Responsibility for Unlawful Processing of Worker’s Comp Claim

An Arizona court has denied SeaBright Insurance Company’s (“SeaBright”s) motions for summary judgment after the carrier was sued for bad faith during the handling of our client’s worker’s compensation claim. The first motion argued there was insufficient evidence to find the insurance provider acted in bad faith. In their second motion, SeaBright claimed our client failed to provide proper evidence pertaining to medical damages, lost earning capacity, and lost credit reputation.  These efforts to avoid legal accountability were denied.

The Abuse of Undocumented Workers in Texas

A recent article in Texas Monthly’s “Hurting for Work” series highlights  how some employers take advantage of undocumented workers. The process involves unskilled laborers without valid work permits being constantly maimed or killed while engaging in dangerous construction jobs. The overseeing contractors may have a history of workplace accidents and even be working under various company names. However, because Texas does not require  employers to provide worker’s compensation insurance, these workers are discarded and forgotten once hurt.
