Texas Third District Court of Appeals Sides with Injured Worker’s Surviving Wife, Affirms Lower Court

On March 30, 2011, the Texas Court of Appeals, Third District, at Austin, ruled against Zurich American Insurance Company (Zurich) and found that an injured employee’s wife was entitled to his benefits for an on-the-job injury.  The Appeals court’s ruling affirmed the findings of both the 33rd District Court of Burnet County and the Texas Department of Insurance, Division of Workers’ Compensation (DWC).

Doyle Files Workers’ Compensation Bad Faith Suit Against ACE, Sedgwick

Doyle filed a workers’ compensation bad faith lawsuit on April 29, 2011, against Indemnity Insurance Company of North America (“ACE”)–an ACE Group insurer–Sedgwick Claims Managment (the third party claims administator), and their adjuster, on behalf of an employee who was injured on the job in April 2010. Despite documentation of his injury from his employer, ACE denied the employee’s claim for the medical and income benefits he was entitled to under Texas law. ACE only initiated benefits after being ordered to do so by the Texas Department of Insurance, Division of Workers’ Compensation.

Doyle Files Workers’ Compensation Bad Faith Suit Against ACIG, Sedgwick

On May 16, 2011, Doyle filed a workers’ compensation bad faith lawsuit against American Contractors Insurance Group (ACIG), third-party claims administrator Sedgwick, and their adjuster, on behalf of an employee who was injured on the job in February 2010. Without reason, ACIG and Sedgwick denied the employee financial and medical benefits after his on-the-job injury, and only initiated benefits after being order to do so by the Texas Department of Insurance, Division of Workers’ Compensation.
