Doyle LLP Trial Lawyers has filed suit against Zurich American Insurance Company, Gallagher Bassett Services, Inc., and Patricia Sampson. The case was filed in the Superior Court of Maricopa County in Phoenix, Arizona. The suit alleges that the Defendants engaged in conduct in violation of Arizona law.

This suit was filed to collect a legal debt and damages due and owing Doyle LLP’s Client because of Defendants’ wrongful acts in handling of his claim for an on-the-job injury. The Defendants, individually and/or collectively, engaged in conduct that wrongfully denied and/or unreasonably delayed payment of workers’ compensation benefits for on-the-job injuries sustained by the client.

Doyle LLP’s Client was injured in the course and scope of his employment on or about August 2, 2015, when he fell while at work resulting in loss of consciousness and neck and back injuries. Rather than properly investigate and adjust his workers’ compensation claim to ensure he would receive the medical, financial, and other benefits to which he was entitled as a beneficiary of the workers’ compensation promised to him and his co-workers, without a reasonable basis or adequate investigation, Defendants chose to continue to deny timely approval and payment of the medical care and insurance benefits to which he was entitled. Indeed, Defendants denied benefits just two days before Doyle LLP’s Client was scheduled to have surgery.

As a direct result of the numerous delays and denials, Doyle LLP’s Client was forced to hire and pay a lawyer to help him secure the workers’ compensation benefits to which he was entitled. After proceeding through all preliminary proceedings before the Industrial Commission of Arizona, he was able to secure a binding final determination from the Industrial Commission of Arizona, ordering payment of the long overdue benefits that he deserved and earned. The Award by the Industrial Commission of Arizona exhausted all available administrative remedies. However, the delays had consequences on Doyle LLP’s client. They caused him to suffer damages separate and distinct from his on-the-job injury, including but not limited to additional physical pain and suffering, mental anguish, credit and other financial damage, lost future and past wages, permanent impairment, lost enjoyment of life, and out-of-pocket expenses.
