Workers Compensation Bad Faith
Doyle LLP Trial Lawyers has filed suit against City of Mesa, Arizona and its adjuster, Dianne Armstrong. The case was filed in the Superior Court of Maricopa County in Phoenix, Arizona. The suit alleges that the Defendants violated the duty of good faith and fair dealing by denying her claim for workers’ compensation benefits.
Doyle LLP’s Client, a loyal and hard-working patrol officer for the City of Mesa, was injured in the course and scope of her employment on or about May 12, 2015, when she was witnessed an officer-involved shooting involving her partner. This incident resulted in Doyle LLP’s client being diagnosed with posttraumatic stress disorder (PTSD).
Doyle LLP’s Client’s claim, which arose from a traumatic experience and well-documented injuries, was summarily denied by the Defendants. Indeed, the Defendants ignored their obligation to provide reasonable and necessary medical treatment and income benefits to employees injured on-the-job.
Rather than properly investigate and adjust Doyle LLP’s Client’s workers’ compensation claim to ensure she would receive the medical treatment and income benefits to which she was entitled as a beneficiary of the workers’ compensation promised to the employees of City of Mesa, without a reasonable basis or adequate investigation, the City of Mesa chose to continue to deny timely payment of the insurance benefits to which she was entitled. The City of Mesa and its agents instead refused to approve medical treatment and issue payments owed to her. As a direct result, Doyle LLP’s Client was forced to hire and pay a lawyer to help her secure the workers’ compensation benefits to which she was entitled. It was only through proceedings before the Industrial Commission of Arizona and with the assistance of an attorney that she was able to force the City of Mesa to reverse its denial. Indeed, on August 15, 2016 and October 18, 2016, the City of Mesa was ordered to pay the long overdue benefits in awards issued by the Industrial Commission of Arizona.
Unfortunately, Defendants’ delays and denials had consequences for Doyle LLP’s client, subjecting Doyle LLP’s client to significant economic impact, humiliation, worry, distress, and continuing economic and physical/mental damage. Doyle LLP’s client has also suffered financial harm as a result of the Defendants’ repeated delays and denials.
