Doyle LLP Trial Lawyers has filed suit against Ace American Insurance Co. (“Ace American”) and Sedgwick CMS (“Sedgwick”) for breach of duty of good faith and fair dealing. The claims of bad faith practices are due to continually delayed payment by the defendants for a contractually valid compensation claim made by the Plaintiff.

On November 17, 2014, the Industrial Commission of Arizona issued a decision finding the Plaintiff’s work related injury claim to be a compensable claim. The court finalized the decision on December 17, 2014. Instead of following the Commission’s orders, the Defendants have continued to withhold payment from Plaintiff.

Furthermore, the Defendants have failed to communicate with our client regarding the claim and owed payments. These actions have left our injured client confused and with little information regarding how best to collect upon much needed support. In failing to pay and communicate the defendants have clearly breached their responsibilities.
